Know Your Rights: Layoffs and Reductions in Time

Owed to the harsh and harmful austerity measures being imposed on our campuses, many UC teaching faculty have yet to receive their reappointment letters. Your Unit 18 Collective Bargaining Agreement provides some important protections when it comes to layoffs and reductions in time that you should keep in mind.

If you currently hold a multi-year appointment, 2 year or 3 year, or a Continuing Appointment, your department must provide written notice of any changes in your appointment, including a layoff or reduction in time.  A notice should  include:

  1. Advance written notice of the effective date of any layoff or reduction in time; 
  2. The notice shall identify whether the layoff or reduction in time is due to a programmatic change, budgetary considerations, or a lack of work; 
  3. The University shall provide a copy of the notice to your Union within five (5) business days.

For pre-six Unit 18 faculty on quarterly appointments, or an initial (1 year contract) academic year appointment, notice for layoff or reductions in time of multiple courses includes: 

  • 30 Days advanced written notice, 30 day pay in lieu of notice. 
  • 30 days prior to first day in service period, September 22
  • Deadline: August 23

For pre-six Unit 18 faculty with academic year appointments, notice for layoff or reductions in time of multiple courses includes: 

Ten (10) full or partial quarters:

  • 90 Days advanced written notice, 30 day pay in lieu of notice. 
  • 90 days prior to first day in service period, September 22
  • Deadline: June 24

Four (4) through nine (9) full or partial quarters:

  • 60 Days advanced written notice, 30 day pay in lieu of notice. 
  • 60 days prior to first day in service period, September 22
  • Deadline: July 24

Protections for teaching faculty with Continuing Appointments or Senior Lecturer status in regard to layoffs and reductions in time are even stronger. These include:

If you have a Continuing Appointment and or Senior Lecturer status, notice of layoffs requires:

  • 12 months notice
  • 2 years reemployment rights for Continuing Lecturers
  • 3 years reemployment rights for Senior Lecturers

If you have a Continuing Appointment and or Senior Lecturer status, a Reduction in Time of 1 Instructional Workload Credit (IWC) or LESS requires:

  • 30 Days advanced written notice, 30 day pay in lieu of notice. 
  • 30 days prior to first day in service period, September 22
  • Deadline: August 23

If you have a Continuing Appointment and or Senior Lecturer status, a Reduction in Time of 1 Instructional Workload Credit (IWC) or MORE requires:

  • 60 Days advanced written notice, 60 day pay in lieu of notice. 
  • 60 days prior to first day in service period, September 22
  • Deadline: July 24

TAKE ACTION

Despite the fact that Governor Newsom reduced the cuts to the UC budget, our campus administrators continue to impose harsh and harmful austerity measures across the state, in many cases cutting more funding than appears to be needed. At least 150 lecturers and librarians have already had their classes cut and jobs reduced or eliminated. We need to make it clear to the UC Regents that these drastic cuts have consequences, for our colleagues, our families, and our students. Take action below to defend undergraduate education at the UC.

Join over 500 UC-AFT members and sign our petition telling UC Regents and President Drake to STOP THE CUTS!, rehire those who have been unnecessarily laid off, and restore the classes that have been cut across our campuses. We will be delivering this petition to the Regents at the July 15-17 meeting at UCLA.

  4. Write a Letter: Fund the Humanities at UCI
    1. UCI lecturers and Academic Student Employees are fighting for our students and the School of Humanities against catastrophic cuts. These cuts have caused layoff notices to go out to beloved teachers and a massive reduction in course offerings that will delay students graduation. The majority of UCI’s structural deficit is caused by overspending in its administrative and support units, NOT its schools. If UCI’s administration had not overspent core funds by 16% last year, or $10 million, no cuts to any UCI schools would be needed.
